Registered Nurse Recruitment: Visa Bulletin Update: November 2021 (U.S.)

​The Department of State has released the Visa Bulletin for the month of November 2021. This is the second bulletin of the fiscal year.

The headline in the upcoming month’s Visa Bulletin is the significant, yet expected, retrogression in EB-3 India and China, and the closing of the window for EB-3 India downgrades.

There are not many changes across the other preference categories.

  • EB-3 Other Nationalities (CURRENT)
  • EB-3 for Philippines (CURRENT)
  • EB-3 for India (15 JAN 12) – will retrogress around two years
  • EB-3 for China (22 MAR 18) – will retrogress around one year

For the millions of people waiting in line in the employment-based and family-based categories, the Visa Bulletin predictions give them an idea of when they will be able to become lawful permanent residents (LPR). It is important to understand that the dates above have been calculated from data provided by USCIS and the State Department. It does not include future demand which can increase or decrease at anytime.

Why is there not much employment-based movement and why is there retrogression at EB-3 India and China at the start of this fiscal year?

USCIS had been advancing the cutoff dates for employment-based cases very agressively over the past 6 – 12 months and, as a result, many applicants were able to submit their I-485 applications with USCIS. As a result, it appears that USCIS has a sufficient number of EB-3 cases (India and China) to use the newly-available quotas for the fiscal year – at least for the initial months. Due to this, they are slowing down the rate of I-485 filings by retrogressing the cutoff date for EB-3 India and China.
